The general terms and conditions of the Motomaxx - Motoristicna trgovina online store are drawn up in accordance with the Consumer Protection Act, the recommendations of the Chamber of Commerce and Industry and international codes for e-business.

Definition of terms

  • provider is Motomaxx Industrijska cesta 11 6310 Izola
  • user is a person who uses our system, i.e. a customer in the online store
  • the online store is an information system intended for the presentation and sale of products to the user

Login

When registering in the online store, the visitor obtains a username and password. The password is secret and known only to the user. The user is obliged to ensure that his password will be used personally or by a person authorized to act on his behalf. The user's username and password are unambiguously defined and linked to the filled-in data. After registration, the visitor becomes a user and acquires the right to purchase. The general business conditions deal with the operation of the Motomaxx online store (www.motomaxx.net), user rights and the business relationship between the provider and the customer.

The provider undertakes to always provide the buyer with the following information:

  1. company identity (company name and registered office, register number)
  2. contact addresses that enable fast and efficient communication (e-mail, telephone)
  3. essential characteristics of goods or services (including after-sales services and guarantees)
  4. product availability (each product or service offered on the website should be available within a reasonable time)
  5. terms of product delivery or service performance (method, place and deadline of delivery)
  6. all prices must be clearly and unambiguously determined, it must be clear whether they already include taxes and transport costs
  7. payment and delivery method
  8. time validity of the offer
  9. the deadline during which it is still possible to withdraw from the contract; in addition, also about if and how much it costs the customer to return the product
  10. the complaint procedure must be explained, including all information about the contact person or customer service department

Purchase process

When the user selects a product or products and submits an order by pressing the FINISH PURCHASE button, the online store automatically "generates - creates" and sends an e-mail with the details of the order (products, prices, quantities, user data...). the order is confirmed, the products will be sent as soon as possible. If the delivery deadline is more than 2 working days, the provider informs the buyer.

Right to withdraw from purchase, return of goods

The consumer has the right to inform the company within fifteen days that he withdraws from the contract, without having to give a reason for his decision. A message is considered timely if it is sent within the deadline. The only cost charged to the consumer in connection with withdrawal from the contract is the direct cost of returning the goods. The latter must be returned to the company no later than thirty days after the notice of resignation. The products must be unused, undamaged and in the original packaging.

Payment

The provider issues an invoice on a permanent medium, with itemized costs and a notification to the user on how to withdraw from the purchase and how to return the products.

Delivery period

For products in stock, delivery takes 2-4 working days, and in other cases, up to 15 days. For products that we do not have in stock, the delivery time is up to 15 days after receiving the order. In case of a longer delivery time, we will inform you about the delivery time by e-mail or by phone.

Delivery

The provider must deliver the goods or services within the promised time. Upon delivery, the user must provide additional information regarding the right to withdraw, especially the conditions and method of exercising the right itself. It must provide all necessary information regarding the address where the user can contact in case of a complaint and information regarding guarantees and service or other services after the conclusion of the contract. Delivery costs are calculated according to the valid price list of the delivery service. Personal collection is possible at the company headquarters on weekdays between 8 a.m. and 5 p.m., on Saturdays between 8 a.m. and 12 p.m. Be sure to bring the printed invoice with you, which you received by e-mail with the confirmation.

Postage

Delivery of ordered products during the working week from Monday to Friday is as shown next to the product. Postage for the delivery of the ordered goods is paid by the buyer according to the valid price list  of the Post of Slovenia or other parcel post, which delivers the goods to the home...

Warranty

Every customer has the right to claim. In doing so, he must present the original purchase invoice and state the reasons for the complaint. Shipping costs are always borne by the buyer, unless otherwise agreed in advance. In case of defects due to improper use, negligent handling, mechanical damage and defects in the event of force majeure, the warranty and thus the possibility of complaints do not apply. It is also not possible to assert complaints in the event that the goods have been tampered with by foreign, unauthorized persons, in case of incorrect management or careless handling or the use of non-original elements. Products in the online store are subject to warranty conditions in accordance with Slovenian legislation. To claim a warranty or service, please contact Motomaxx headquarters. When purchasing online, the warranty begins on the day the shipment is delivered.

Validity of the offer

When purchasing, the prices apply at the moment of order confirmation. All prices include VAT, except for used items, for which VAT is calculated on the basis of Articles 48 and 49 of the ZDDV and is not disclosed on the basis of the Article 50 C of the ZDDV. Prices in the online store may change without prior notice. Images can only be symbolic and do not always fully reflect the actual situation.

Security

The provider uses appropriate technological and organizational means to protect the transfer and storage of personal data, orders and payments.

Communication

The provider may contact the user via means of remote communication only if the former does not expressly oppose it. 

Archiving contracts

Advertising electronic messages must contain the following components:

  1. They must be clearly and unambiguously marked as advertising messages
  2. the sender must be clearly visible
  3. various campaigns, promotions and other marketing techniques must be labeled as such. Also, the conditions of participation in them must be clearly defined.
  4. the user's wish not to receive advertising messages must be respected

Complaints

The provider complies with applicable consumer protection legislation. The provider must set up an effective system for dealing with complaints and designate a person with whom, in case of problems, the buyer can contact by phone or e-mail. The procedure for submitting complaints must be available on the website, easy to use and confidential. Within five working days, the provider must confirm that it has received the complaint, inform the customer how long it will take to process it and keep him informed about the progress of the procedure. The provider is aware that an essential feature of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer not to initiate a dispute before the court. Therefore, the provider makes every effort to resolve any disputes amicably.
